/If you are considering purchasing a property in Victoria with the intention of leasing it out under a residential tenancy agreement, it’s critical to seek advice before signing any contract of sale.
The Residential Tenancies Act 1997 (Vic) is undergoing substantial changes, with new minimum rental standards coming into effect from 1 October 2025. These updated standards will place additional compliance obligations on residential landlords—obligations that can be expensive to meet if not factored in before purchase.
At Victorian Property Settlements, we’ve developed a bespoke special condition to be inserted into the Contract of Sale. This condition gives you, the purchaser, the right to:
Arrange access for a qualified property manager and any necessary tradespersons to inspect the property;
Obtain a costed report identifying any upgrades needed to meet the upcoming 1 October 2025 rental compliance standards;
Withdraw from the contract with a full refund of all deposit monies if the estimated cost of upgrades exceeds $4,000.
This condition has been designed with reference to the Residential Tenancies Act 1997 (Vic) and is intended to ensure compliance with the expected rental safety and amenity standards. It provides a safety net to avoid being locked into a contract that could result in expensive remedial works—particularly important for trustees of self-managed superannuation funds, who must comply with strict investment and fiduciary standards.
Most importantly, this clause must be inserted before you sign a contract.
Once the contract is signed without this protection, your ability to cancel based on later discoveries is extremely limited.
